Terms and Conditions Page:

www.nevillsonline.co.za (“the site”) enables buyers to shop for items including clothes, shoes and accessories by selected local and international brands (“the products”) online.

All visitors to the site (“users” or “you”) will be able to see the products on offer, but only those who have registered for an account on Nevills Online (“Nevills Online account holders” or “you”) are able to buy, unless otherwise stated or determined by the site.

Legally binding contract

All users and account holders, including those that buy from the site (“buyers”) are bound by these terms and conditions (“Ts & Cs”). By registering, or using the site at all, you recognize that you’ve read and accepted these terms and conditions.

 

With whom are you entering into a contract?

The site is owned and run by Nevills, registration number ck2006/130099/23, a company incorporated in the Republic of South Africa (herein after referred to as “Nevills Online”).

Products and availability

Please note that the stock of all items on offer is limited. Nevills Online will make all reasonable attempts to ensure that special offers are brought to an end when stock runs out.

If it happens that Nevills Online is unable to fulfill any order at the advertised price because stock is sold out, Nevills Online will let you know and you’ll be entitled to a reimbursement for the rand value you have paid for such product.

This is described in more detail in Nevills Online Delivery and Returns Policy.

Buying products

The site allows you, the user, to place electronic orders (“order”) for one or more products on offer as long as such products are available and not sold out.

A purchasing contract (“sale”) between you and Nevills Online only comes into effect once you have fully completed AND submitted the online order form for one or more products in your basket (“shopping cart”) AND your payment has been authorized by Nevills Online (or has been received into Nevills Online bank account).

The above is dependent on the product being available. 


Products on Nevills Online cannot be reserved to be bought at a later stage, and placing an item in your basket without completing the order does not amount to a sale or an order.

This means that Nevills Online may remove any item from your basket before the sale actually takes place in the event of the product going out of stock.

Nevills Online cannot be held responsible if an order has become unavailable by the time you try to complete a purchase at a later stage. The invoice for your purchase will be available online in the “My Account” section on the site.

Cancelling and ending orders

Nevills Online reserves the right to refuse processing of payment for any order and/or to cancel any purchase, partially or completely, with notice given to you.

Nevills Online will be liable for reimbursing you the rand value paid only if you have already paid for the cancelled order. You have the right to return item(s) purchased (see Nevills Online Delivery and Returns Policy for more information).

Fraud

Nevills Online reserves the right, in the interest of preventing fraud, to refuse the processing of payment for any order and/or to cancel any purchase, partially or completely.

Nevills Online may request documentation to complete the necessary fraud checks and cancel any order where the necessary documentation is not provided in a timely manner.

In the event of a fraudulent purchase being placed on Nevills Online, cardholders will be advised to initiate a chargeback via their bank in order to be refunded. Nevills Online does not process refunds for orders suspected of fraud.

Nevills Online does not provide order details relating to orders suspected of fraud.

What you pay for

The price of each product is given in the product information. In case of a sale or special offer, the discount price is shown. In the case of a sale, two prices are indicated alongside each product, as follows:

Purchase price

The price that has not been crossed out, is the price you pay if you buy the product from Nevills Online. RRP (regular retail price):

The other price (indicated by the crossed-out RRP) is the supplier’s usual (“RRP”) and is given purely as an indication of approximately how much you save by buying the product from Nevills Online. The RRP shown is determined according to the market and prices of other suppliers.

Please note that RRPs can change over the course of several seasons over which the product may be sold. The RRPs applicable at the time the product is introduced may differ from the supplier’s RRP at the time of your purchase. As such, Nevills Online offers no guarantee whatsoever regarding accuracy of any RRPs displayed.

Delivery and Returns Policy

1. Delivery Policy

Nevills Online delivers free of charge, door-to-door or door-to-counter, within the borders of South Africa, provided the order value exceeds R800.

For orders under R800, Nevills Online will charge a R100 fee to deliver either door-to-door or door-to-counter, depending on your location.

Deliveries to Neighbouring Countries cannot be done at this time.

Please note that once you have checked out your purchases, we will unfortunately not be able to amend the delivery details of your order.

Nevills Online will determine your optimal delivery method, based on your delivery address and postal code provided during the checkout process, whether this be door-to-door or door-to-counter

Nevills Online will endeavour to deliver in 2 – 7 working days depending on where you live within South Africa.

We offer South African shoppers 30 days to return their products to Nevills online free of charge.

All customers, no matter how much they spend on their order, will have 30 days to return their items to Nevills online, free of charge.

You are entitled to cancel your purchase within 7 days’if the products you have purchased are not delivered in the agreed delivery period as specified in the terms and conditions.

The product(s) in question must be returned to Nevills on-line in their original state, including all labels and packaging.

2. Late Delivery

You are entitled to cancel your purchase within 7 days’ if the products you have purchased have not been delivered within the agreed delivery period as specified in these terms and conditions.

The product(s) in question must be returned to Nevills on-line in their original state, including all labels and packaging.

3. Stock shortages

Every effort will be made to ensure that we fulfil your entire order once a sale comes into effect.  However, if when packing your order, we are unable to fulfil certain product(s) in your order:

We will notify you there of by emailing you and refunding the article, if payment has been received and you wish to be refunded for the products that could not be sent to you

Your refund will be allocated to your credit card should you have paid by credit card, and into your bank account should you have paid by EFT when you placed your order.

If Nevills Online does not notify you thereof via email beforehand, and you only become aware of the fact that the product(s) is/are missing once you receive your parcel, please contact Nevills Online as soon as possible so that we can resolve the situation as soon as possible.

Please use your order number as your reference number in all correspondence

4. Exchanging non-defective product(s)

Within 30-days of your order being delivered to your door or to your nearest post office, you can exchange the product(s) you ordered for a different size or colour of the exact same product as long as the preferred size or colour being requested is available.

Should we not have stock of your preferred size, or if you wish to order a different product, please follow the returns procedure for non-defective products as outlined in above.

Please note, Nevills Online reserves the right not to accept an exchange if the product you wish to exchange is not sent back to us in the same packaging it was received in, with labels attached, in resalable conditions.

5. Returning non-defective product(s)

5.1 Save for certain products that are excluded from this policy (including purchases of underwear and swimwear, you are entitled to return any purchase from Nevills Online within 30 days of the product(s) being delivered to you. Nevills Online will also pay the cost associated with collecting the return from you.

In order to obtain a refund to the rand value of the purchased items being returned, the product(s) being returned must be sent back to Nevills Online in accordance with the return procedure.

5.2 Consequently, if upon receiving your purchase you are not satisfied with your choice of product(s) and wish to return it for a refund as aforesaid, please retain the product(s)’ original packaging, with labels attached, and do not wear the product.

5.3 Products delivered outside South Africa are not eligible for returns.

6. Returning incorrect product(s)

Nevills Online will make all reasonable efforts to ensure the product information, availability, purchase price and associated delivery times and fees are accurately reflected on the site.

However, should Nevills Online deliver the incorrect product(s) to you by mistake please do not remove the product from its original packaging, do not remove the labels or try the product on at all. Please notify as soon as possible, we will resolve the error as quickly as possible.

7. Returning defective product(s)

Within 3 months of receiving a product, you find that the product is faulty, not commercially acceptable, unsuitable for the purpose generally intended (or otherwise expressly indicated by Nevills Online at time of purchase), or not legal or reasonably durable (based on the circumstances and product type) ;

7.1 Please notify us. We will request pictures of the defective product and arrange to collect such product from you so that it can be inspected by our Quality Assurance team.

If the product is subsequently found to be defective, you may elect to:

(a) be fully refunded, or

(b) have the product repaired or replaced at Nevills Online expense (this decision would be Nevills Online, depending on availability and other circumstances, and in this regard you acknowledge that products on Special will usually only be able to be repaired).

If the product is found NOT to be defective and is commercially acceptable, you will NOT be entitled to any repair, replacement or refund but will instead be liable for the costs incurred in having had such product returned to us, and then redelivered to you.

7.2 A product is deemed not to be defective and you will NOT be entitled to any repair, replacement or refund under the general warranty above if

(a) The faults/damage is a result of normal wear and tear;

(b) damage arising from incorrect usage  or storage of the product;

(c) the item has a reasonable amount of manufacturing or production imperfections, but is acceptable in accordance with the generally accepted commercial practices.

8. Exclusions

Unless defective, the following product types may not under any circumstances be returned to Nevills Online:

8.1 For hygiene reasons, due to their nature: non-defective underwear is not returnable. You may, however return swimwear, but we’ll only accept the return if the hygiene strip is still in position and it’s clear the garment has merely been tried on and not worn. We also request that you keep on your underwear when trying on our swimwear.

8.2 Products that you or any other person has altered, repaired, incorporated or added to where such alteration, repair, incorporation or addition has not been authorised by Nevills Online.

9. Return procedure to be followed is outlined above in this document

Place of delivery

Nevills Online delivers within business hours in the Republic of South Africa. As buyer, you indicate where in South Africa you require delivery, as well as contact numbers to be used in connection with delivery. Your parcel will be delivered to the address you specify in the checkout process.

In the case of door to door delivery, if nobody is present at the address at the time of delivery, our courier will on the second attempt of delivery use the mobile phone number you provided in your order and/or leave a note (in the letterbox if a residential address) to indicate that there was an attempted delivery.

The courier will try once more, and if at that time there is still no one to sign for the parcel, it will be your responsibility to call and notify us to arrange delivery.

If you don’t contact the Nevills Online call centre within 5 working days of the courier attempting the second delivery, the courier will return the parcel to Nevills Online, and we will contact you via email to discuss potential redelivery at your own cost.

If this attempt does not succeed within a reasonable amount of time, Nevills Online will simply reimburse you less an administration cost.

Delivery time and delays

Unless we inform you otherwise, the estimated maximum delivery time for an order in South Africa is 7 working days. Deliveries are made to street addresses or to your nearest post office, with no deliveries to PO Box addresses.

All Nevills Online deliveries take place during business hours i.e. there are no deliveries over weekends or on public holidays. Please take this into consideration when selecting your delivery address.

Delivery completed

A delivery is considered complete as soon as the parcel is handed to an individual at your specified delivery address, or you are notified that the parcel is waiting for you. This also applies when the package has been handed over by the courier, as indicated in the courier’s tracking system.

It is your responsibility, as buyer, to ensure that you or the intended receiver of the gift (when applicable) inspect(s) the parcel on arrival and makes known any justifiable complaints. The receiver has the right to refuse the parcel if it appears to have been opened or if it has clearly been damaged.

Such complaints and claims must be brought to our attention as soon as possible.

Lost parcels

If neither the depot nor the tracking system of the courier company can provide any indication where the parcel is, you need to inform us as soon as possible.

If the parcel is found, it will be sent to the specified delivery address by the usual procedure, as set out in the delivery clause.

If the parcel is declared lost, Nevills Online will notify you and reimburse you for the lost parcel (to the amount of the product purchase price and any relevant delivery fee).

All returns must be sent back within 7 days to warrant a review for credit processes. Anything longer without pre authorization and acknowledgment will be rejected and all costs incurred will be for the customers (Returnee’s account) all returns need to be sent back in original packaging with all labels attached, and if not will void returns and costs thereof will be for the returnees account. Credits that are approved and legitimate will then be credited within 7 days of receipt

Discount Vouchers and Coupons

Nevills Online may release printed or digital discount vouchers/coupons [hereafter referred to as vouchers] from time to time. Such vouchers may be available through the website and/or from third-party websites, in magazines and other media.

Vouchers can be used for discounts on the site only as long as the voucher is valid. Given expiry dates cannot be moved.

Promotional vouchers

Promotional vouchers are issued at Nevills Online discretion. Users don’t have the right to promotional vouchers and can’t earn them. Promotional vouchers are issued with specific terms and conditions that regulate how and when they can be used.

In general, unless otherwise specified on the voucher itself: a voucher is only valid for 30 days from date of issue. A voucher can only be used against a purchase on the site when the purchase meets the terms and conditions as specified on the voucher.

A voucher can only be used once and only one voucher can be used per shopping basket. Vouchers are not transferrable and cannot be exchanged for cash. The discount value of the voucher will be deducted from the total amount in your shopping cart. The remaining balance, if any, must be paid by you.

Promotion vouchers cannot:

1. Be used to buy other vouchers

2. Be exchanged for cash

3. Be transferred to anyone else

4. Be used after the expiry date which is 30 days from date of issue

5. Be used together with any other promotion, including against sales/ clearance items that have already been discounted or are on special offer 

Gift Vouchers

Nevills Online may make physical and/or electronic gift vouchers (“Vouchers”), as well as electronic promotional coupons (“Coupons”) available on the Website from time to time. 

Vouchers and Coupons can only be redeemed:

1. While they are valid, their expiry dates being unable to be extended; on the Website towards the purchase of Nevills Online products.

Vouchers cannot be:

used to purchase other Vouchers or Coupons;

used towards purchases at any affiliate websites or

exchanged for cash

Security

Anyone downloading or trying to download malware or damaging coding on this site, or who tries to gain unauthorized access to any page on this site, will be prosecuted.

Nevills Online will claim civil damages from such person if Nevills Online suffers any damage or loss.

You agree and guarantee that the username and password you use to log in is for your personal use only, and will not be passed on to any third party.

You allow Nevills Online to take all steps reasonably possible to ensure the integrity and security of the site and in the administrative office.

All credit card transactions on the site are protected by SSL (Secure Socket Layer) encryption and reinforced by various encryption processes with the aim of offering the most effective possible protection of any sensitive information. Nevills Online has no access to any confidential information regarding your payment method.

Only Nevills Online banking partner will access confidential information (such as your credit card number, expiry date, CVV etc.) from time to time.

Indemnity

Nevills Online is responsible for adhering to the Consumer Protection Act 68 of 2008 (“CPA”) with the sale of any products from the site. Similarly, Nevills Online is responsible for adhering to articles 43(5) and 43(6) of the Electronic Communication and Transactions Act in terms of payment systems and security.

However, neither Nevills Online nor any of its representatives will be held responsible for any loss or accountability of any kind that arises from the use of (or inability to use) this site, its services or content.

Furthermore, Nevills Online provides no guarantee, implied or otherwise, that the content or technology attached to this website is free or errors or omissions. Nor is there any guarantee whatsoever that service will be 100% uninterrupted or faultless. We encourage you to report any possible malfunctions and errors by emailing support@nevillsonline.co.za.

Applicable Laws

Should any court or qualified authority find that any of the terms are invalid or unenforceable; the remainder of the terms and conditions will remain standing, despite invalidity or unenforceability of an individual term.

Privacy

Nevills Online has to take all reasonable steps to protect your personal information. For the ends of this clause, “”personal information”” is defined according to the details in the Promotion of Access to Information Act, number 2 of 2000 (PAIA).

Nevills Online is authorized to gather, store and use the following of your information:

Citizenship
Nearest city
Non-personal click patterns
Email address
IP address, and
ID or passport number

Nevills Online is entitled to gather, store and use the above information for the following purposes:

1. To greet you when you access the site

Changes to terms and conditions

Nevills Online may, at its own discretion, change these terms and conditions or any part thereof. If you are a registered account holder, Nevills Online will in its best efforts inform you of changes by email (to the address you use on registration). At such point, it will be your responsibility to read through the revised terms and conditions to ensure you’re satisfied.

If you’re dissatisfied, you have the right to terminate your registration on Nevills Online.

If you are NOT a registered user, Nevills Online will be unable to let you know of changes to these terms and conditions.

It will be your own responsibility to visit the website to check whether the terms and conditions have changed, and to make sure you’re satisfied with the changes. If you’re dissatisfied with any changes, you should not use the site in any way.

Disputes

Barring urgent or interim legal help that may be granted by a court of law: In the event of any disputes of any kind between you and Nevills Online, arising out of any situation catered for in these terms or conditions (or that arises out of these terms and conditions) and that cannot be resolved by the client service centre, the dispute may be presented for confidential arbitration.

Such arbitration will be handled according to the rules stipulated by the Arbitration Foundation of South Africa.

Terms and Conditions

These terms and conditions take effect on the date of first publication of the website and continue indeterminately. They may be revised by Nevills Online from time to time (as described above), for as long as the website continues to exist and be operated. Nevills Online is entitled to terminate these terms and conditions or close down the website at any time, subject to processing any pending purchases.

If you don’t meet your obligations regarding these terms and conditions, including any incidents about payment and price or an order, and you neglect to rectify such non-adherence within 7 working days after Nevills Online has instructed you to do so, your access to the service will be blocked.
